Tax Question: Help with Chapter 13

We have not filed taxes for 4 years and are in debt beyond our means.

We are wanting to rectify the situation with the IRS, but can we file a Chapter 13 since we had a Chapter 7 dismissed in Jan 2006, and could we include the taxes that we owe (assuming that we do) in that Chapter 13?

If so, is there someone with a reasonable fee to do both? Please help.

  1. The dismissal of your chapter 7 bankruptcy in 2006 should not prevent you from filing a bankruptcy case now under chapter 13. Prior discharges in prior cases are much more important. You would have to provide for payment of all of your taxes during the 5 years of a chapter 13 plan unless the government agrees otherwise. So unless you can do this, negotiations with the IRS outside of bankruptcy would be the only alternative.
