My mother is 85 and just re-wrote her will herself. It is really a trust. To me it seems to be full of loopholes and unclear statements. Verbally, she has told all 4 of her children for MANY years that everything is to be divided equally when she dies, so that has been well-understood by all. She doesn’t want to take this to a lawyer because she thinks she can do this herself. She wants to keep it out of probate.

1.) She’s not thinking as clearly as she used to, but she’s not incompetent. Some paranoia. Seems to be very dependent upon a live-in brother, age 55, who takes minimal care of her (cooks, takes out garbage, mows)

2.) Our brother is 55 and living with her…has been living there for 20 years. He doesn’t work, lives an adolescent-type lifestyle of staying up until 3 a.m. and sleeping until noon. It is a complicated relationship, but basically is a co-dependent dysfunctional one in which she needs him so enables him, and he needs her and accepts. She pays him to run her errands, take her to the doctor, clean her house, etc.

3.) Due to instability of this brother and past observations of odd behavioral tendencies, we (the other 3 siblings) really don’t trust him too much.

4.) He has a legal background and has encouraged her to rewrite the will. The role of the executor has been eliminated and each of the 4 children have been given roles. 1 is to be treasurer, 1 handle appraisals, 1 (the live-in) handle ALL LEGAL WORK, 1 keep all the records and keep the peace among the siblings

5.) This has raised several red flags for me. She’s not thinking as clearly. She has not had an impartial lawyer look at it. I think there are a lot of assumptions being made…# 1 that everyone will be trustworthy and honorable in all proceedings.

I also think she has set us up for a big family feud. The live-in brother keeps telling her it is a good document and she doesn’t need a lawyer. I can’t help but to be concerned that he has something up his sleeve. He is and will be the most desperate of the siblings for money. He has high debts, has never held a good job, and I’m afraid he might do something desperate to get more than his fair share of the inheritance.

Question: I don’t want to appear greedy or mailcious, but is there anything we can do?

She has signed it and it is legal now from what she says, but no one has a signed copy but the live-in brother. She is now (after the fact) asking for input. I wanted to suggest a statement saying that any services provided by the live-in brother have been in exchange for room, board and any care he has provided for the past 20 years. My only thought is that he might try to charge her estate for taking care of her for the last 20 years, which he has not. He has only cared for her for about a year or two .

Question: What are our options with a trust?

In the first quarter of 2008, I sustained an eye injury that had me rushed to the emergency room, and under an IV. I was given a prescription for eye drops to accelerate the regeneration of flesh on my eye, and I filled it at Walgreens.

About a week after taking my prescription as advised, my eye was still noticably injured. I commenced into seeing my family optometrist to see if he could further diagnose me. He asked what medication I was taking, and I showed him the prescribed bottle. He then informed me that I wasn’t seeing results because my eye was in fact getting worse. I had not been prescibed optic drops, but actually optic drops for the ear. He told me to review who made this error because it could have cost me my eyesight.

After some minor investigating I found walgreens made the mistake, and I confronted them for it. They admitted it was their fault, and simply apologized, not filling my correct prescription in the process. Since this entire experience, I cannot see correctly out of the bottom of my left eye, even with aided vision.

My peers and family have told me to take action numerous times and I have not, though my small eye problem has become a bother. Is it to late to take action?

Will the case win?

Is it worth it?

I still have all of the paperwork, prescription, prescrition box, and written statements from the incident also.

On May 26th of this year, my husband and I used Western Union to transfer $3000. I transferred the money to my husband in Houston, TX. He was going to go there on a business trip, but it was cancelled, so he remained here in Chicago. On May 27th, someone other than my husband picked up the money. After two months of going around with Western Union, including writing letters to the CEO, President of the Americas, they claim they followewd their internal protocol, and sent me a letter stating they paid the money to the correct person.

I’ve offered to obtain and send signed affidavits from my husband’s employer to prove he was here in Chicago when the money was picked up, but Western Union isn’t interested. Today, I received a letter from the director of Curstomer Advocate Dept. that if I still want to dispute the claim, I should quote, “see the back of the ’send money’ form I completed when sending the money.” I have offered to do whatever necessary to prove our case, but nobody at Western Union cares. At this point, I’m wondering if its possible to sue them for a larger amount in order to get their attention, and also find out if a class action lawsuit may be in order.

Please note that I have not spent the last two months trying endlessly to obtain money that doesn’t belong to me. Your help would be very much appreciated, as I believe this to be a theft from someone at the company, and Western Union doesn’t want anybody to know.

I sent proof of exemption to attorney office on 4/1/09 and have called several times only to get the run around.

I became aware of the freeze when I received a notice from my bank. The attorney’s office also gave me a wrong court date to appear (wrong date on court paper) and continued my case to 5/18/09

.I have been sending in monthly payments and have never received any documents pertaining to payment history and/or regarding what I truly owe (they provide different amounts each time on court docs). I have since filed an appearance for 4/21/09 (by suggestion of judge)

My question is: Can I take any legal action against the collector?

We have a situation where a “contractor” presented himself as licensed, bonded, etc. (We have an insurance claim)

He has taken over 130K of funds and states work to this amount has been done. This is a blatent lie. We also found out that he never pulled the correct permits and is not licensed. Our home is in shambles, I am 7 months pregnant and the city is doing inspections on the home today. (we just found out he did illegal electrical work).

We HAVE filed a complaint with the Attorney General regarding consumer fraud but believe there was criminal fraud done as well as items pertaining to the IL Construction / Homeowners act.

We do not know what type of attorney we should speak to in order to attempt to gain back the funds so that we can get our house up to code, safe and completed. We were looking @ Construction Attorneys as well as Consumer Fraud attorneys and didnt know which would be more beneficial.

Any suggestions would be greatly appreciated. (Obviously this is just a small summary of our ordeal!) …..Thank you

As ME the non custodial parent who unfortunately is current unemployed due to budget cuts, I still have to pay child support even if the other parent doesn’t need nor want it.

With the process of divorcing taking several months, if only a few months before the kids turning 18, am I sitll liable for this even the other parent and I are in agreement that we would help the other out? We’ve been doing ok all along, we just don’t want to be married! Please answer if you would.

Hello, I would like to know if it possible to file a lawsuit against HSBC Bank. The reason i want to file one is because, my wife bought a house last year and she is owner and she is the only one on the mortgage.

She recently lost her job. Because of that she did not make house payments for the last couple of months, I was not on the mortgage, it was never a joint account but I recently found out that HSBC reported the late payments on my Credit File with all the three credit service companies!

I have notifed Transunion, Equifax and Experian and filed a dispute. I hope that the late payment info will be removed from my credit report since I was never a co borrower or a joint account holder, but because of this action by HSBC bank i am losing time and money and I am unable to now get a loan for my business. I would like to know what can I do and if I can sue this bank for its false actions.

Now it seems as if they’re doing it again. Both of us are receiving pension and S.S.I. only, and I feel as if we’re exempt from them doing this. I can’t pay my bills because our funds are directly deposited. I told them this and now they are no longer answering their phone.

Should I get another attorney to force them unfreeze my funds?
